SDSHH Files Amicus Curiae Brief for Amnesty International in U.S. Supreme Court in Key Guantanamo Case

SDSHH Partner Paul Hoffman filed an amicus curiae brief on behalf of Amnesty International, the International Law Association, FIDH and the International Bar Association in the Supreme Court in the Boumediene and Al-Odah cases. These cases present the issue of whether Guantanamo detainees have the right to file habeas corpus petitions in U.S. courts challenging the legality of their detention. The Amnesty Interntional brief argues that the detainees must have access to courts to challenge their detention under Article 9(4) of the Interntional Covenant on Civil and Political Rights, a treaty ratified by the United States, and other international law obligations. Argument in the case is expected before the end of the year and a decision is expected by June 2008.
